NRMA Insurance Safer Journeys – Terms and Conditions

  1. Insurance Australia Limited ABN 11 000 016 722 trading as NRMA Insurance and its related bodies corporate (collectively, “NRMA Insurance”, "we", "our" and "us") allow select customers (“you” or “your”) to access and use a feature of the NRMA Insurance app which provides driving insights based on behaviours like braking, speed and acceleration (“Safer Journeys”).
  1. Activation and use of Safer Journeys is governed by these terms and conditions, together with:

(a) our Privacy Policy;

(b) the NRMA Insurance app Terms of Use; and

(c) the NRMA Insurance Online Terms of Use

(together “the Safer Journeys Terms and Conditions”).
 

  1. By using Safer Journeys, you acknowledge and accept that you are bound by the Safer Journeys Terms and Conditions.
  1. We may change Safer Journeys and/or the Safer Journeys Terms and Conditions from time to time. You will be notified of any material changes via the NRMA Insurance app and can access the latest Safer Journeys Terms and Conditions in the NRMA Insurance app.
  1. Your continued use of Safer Journeys after these Safer Journeys Terms and Conditions have been changed constitutes your acceptance of the updated Safer Journeys Terms and Conditions. However, if we make any change which we consider will materially impact your use of Safer Journeys, you may be prompted to reconsent to the updated Safer Journeys Terms and Conditions to continue to use Safer Journeys.
  1. Safer Journeys is not part of your NRMA Insurance policy, nor does your use of Safer Journeys impact your ability to make a claim under such a policy.

Eligibility

  1. To access and use Safer Journeys, you must:

(a) have an active NRMA Insurance Online Account;

(b) have the latest version of the NRMA Insurance app installed on your mobile device;

(c) have joined Help Hub (and your Help Hub customer account remains active and has not been closed in accordance with the NRMA Insurance Online Terms of Use);

(d) follow the in-app instructions to ensure your mobile device settings enable Safer Journeys to operate.

  1. If, at any time, you cease to meet the eligibility requirements in paragraph 7 above, your access to Safer Journeys may be withdrawn.

Conditions of use

  1. We grant you a revocable, non-transferable, and non-exclusive licence to access and use Safer Journeys for personal and non-commercial purposes strictly in accordance with these Safer Journeys Terms and Conditions.
  1. You agree:

(a) that all trade marks, copyright and other intellectual property rights of any nature in Safer Journeys together with the underlying software code are owned by us or our licensors. No right, title or interest is transferred to you;

(b) that the Safer Journeys feature comprises confidential information of NRMA Insurance and its licensors and must only be used in accordance with these Safer Journeys Terms and Conditions;

(c) to keep your NRMA Insurance app password or PIN secure and confidential;

(d) that you are solely responsible for your data and driving activity associated with your use of Safer Journeys;

(e) to use reasonable efforts to prevent unauthorised access to your NRMA Insurance app, and notify us if you become aware of such unauthorised access;

(f) that you may only use Safer Journeys in accordance with these Safer Journeys Terms and Conditions and applicable law;

(g) while we will use reasonable efforts to make Safer Journeys available at all times, Safer Journeys may be compromised, may not be error free, and use may be interrupted;

(h) your breach of this agreement or violation of the intellectual property rights granted in this agreement may cause us irreparable harm for which damages may not be an adequate remedy. Accordingly, we are entitled to seek injunctive relief in addition to any other remedies available at law or equity. The benefit of this clause extends to our licensor of telematics services.

  1. You must not:

(a) reverse engineer the Safer Journeys feature or use the feature in a service provider capacity;

(b) use Safer Journeys to store or transmit infringing, libelous or otherwise objectionable, unlawful or tortious material, or to store or transmit material in violation of third party rights;

(c) interfere with or dispute the integrity or performance of Safer Journeys;

(d) attempt to gain unauthorised access to Safer Journeys, its underlying technology, related systems or networks;

(e) access Safer Journeys to build a competitive service or product, or copy any feature, function or graphic for competitive purposes.

  1. Use of Safer Journeys for any purpose not expressly permitted by these Safer Journeys Terms and Conditions is strictly prohibited.

Privacy

  1. Without limiting any other consents you provide us from time to time, you hereby consent (and your continued use of Safer Journeys confirms your consent) to the storage, use and disclosure of your personal information by NRMA Insurance in accordance with our Privacy Policy as may be amended from time to time. If the personal information is not provided, you may not be able to access and use Safer Journeys. Our Privacy Policy contains information about how individuals may access, update or correct their information, how individuals may complain about the treatment of their personal information, and how we will deal with such a complaint.

Opting out

  1. Safer Journeys is an optional feature of the NRMA Insurance app and you can opt out at any time by following the instructions in the app (including instructions about updating device settings to stop location and movement data being sent to the NRMA Insurance app).

Limitation, suspension or termination

  1. We may limit, suspend, or terminate your use of Safer Journeys (or part of Safer Journeys) at any time, including if:

(a) you breach these Safer Journeys Terms and Conditions and (if that breach is capable of being remedied) you fail to remedy that breach within 7 (seven) days;

(b) if you act fraudulently or unlawfully in connection with your use of Safer Journeys; or

(c) the security or integrity of Safer Journeys is compromised in any way, it is not capable of being provided as reasonably anticipated due to any reason beyond our control (including due to security or technical issues, unlawful or fraudulent activity), or the provision of Safer Journeys is no longer permitted.

  1. We will endeavour to give you notice of such limitation, suspension or termination, however this may not be possible or appropriate depending on the circumstances.
  1. Where your use of Safer Journeys is terminated or suspended by us for any reason, you must immediately cease using Safer Journeys and not directly or indirectly access or use Safer Journeys further.

General

  1. Except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), NRMA Insurance (including its officers, employees and agents) and its licensors exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special, consequential or incidental, arising in any way in connection with these Safer Journeys Terms and Conditions, including but not limited to any technical difficulties or equipment malfunction (whether or not under NRMA Insurance’s control). Nothing in these Safe Steer Terms and Conditions restricts, excludes, modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law, including the Competition and Consumer Act 2010 (Cth) or the Australian Securities and Investments Commission Act 2001 (Cth).
  1. To the maximum extent permitted by law and subject to any non-excludable rights and remedies (including under the Australian Consumer Law), NRMA Insurance and its licensors expressly disclaim any and all warranties not expressly provided in these Safer Journeys Terms and Conditions.
  1. The laws of the State of New South Wales govern these Safer Journeys Terms and Conditions and your use of Safe Steer. In any action or other legal process with respect to any matter or thing in connection with these Safer Journeys Terms and Conditions, you submit to the non-exclusive jurisdiction of the State of New South Wales.
  1. If part or all of any section of these Safer Journeys Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Safer Journeys Terms and Conditions and the remaining provisions of these Safer Journeys Terms and Conditions will continue to have full force and effect.
